This Refunds Policy (“Policy”) explains how refunds are handled on the crowdfunding platform operated by Chakradhari Foundation, a registered charitable trust having its office at Laxmi Nagar, New Delhi, India (“Chakradhari”, “we”, “us”, “our”). This Policy forms an integral part of the Terms & Conditions governing your use of the Platform.

 

IMPORTANT: Crowdfunding is fundamentally different from e-commerce. Donations made through the Platform are voluntary contributions to support a cause — they are not payments for goods or services. This distinction is critical both legally and practically. By making a donation on the Platform, you acknowledge and accept the terms of this Refunds Policy.

1. General Refund Policy

All donations made through Chakradhari Foundation’s Platform are generally non-refundable. Once a donation is successfully processed:

  • The funds are allocated to the relevant Campaign and made available to the Campaigner for the stated purpose.
  • The donation amount is reflected in the Campaign dashboard and may be partially or fully withdrawn by the Campaigner.
  • Reversals are not guaranteed, as funds may have already been utilized for the Beneficiary’s cause (including medical treatment, emergency relief, etc.).
  • Donors are expected to review all Campaign details, supporting documents, and updates carefully before making a donation.

 

This policy exists because Chakradhari Foundation operates as an intermediary platform. Once funds are transferred to or utilized by a Campaigner, the Platform has limited ability to recover or reverse such transactions.

2. Situations Where Refunds May Be Considered

Refunds are exceptional and are considered only on a case-by-case basis in the following circumstances:

2.1 Duplicate or Erroneous Transactions

  • The Donor is charged more than once for the same donation due to a technical glitch or payment gateway error.
  • The donation amount processed is clearly incorrect (e.g., ₹10,000 charged instead of ₹1,000) due to a technical error.
  • The Donor’s payment method was charged without the Donor’s authorization (unauthorized transaction).

2.2 Failed or Incomplete Transactions

  • Payment is debited from the Donor’s account, but the transaction status shows as failed, pending, or incomplete on the Platform.
  • Funds are debited but do not reflect in the intended Campaign’s balance.
  • IndusInd Bank (IndusCollect) or the relevant Payment Gateway confirms the transaction failure but the amount is not auto-reversed within the standard processing cycle (typically 5–7 business days).

2.3 Fraudulent or Terminated Campaigns

  • A Campaign is found to be fraudulent, misleading, or in violation of Platform policies after investigation by Chakradhari Foundation.
  • The Campaign is suspended or removed by Chakradhari Foundation before the Campaigner has withdrawn the funds.
  • The Campaigner is found to have misrepresented the purpose, Beneficiary, or medical condition associated with the Campaign.

 

In such cases, refunds may be initiated after internal verification, and subject to the availability of funds in the Campaign account.

2.4 Campaign Cancelled Before Fund Withdrawal

If a Campaign is voluntarily cancelled by the Campaigner or terminated by Chakradhari Foundation before any funds have been withdrawn, refunds may be processed to the original Donors, subject to technical feasibility and payment gateway capabilities.

3. Situations Where Refunds Will NOT Be Provided

To maintain the integrity of the crowdfunding ecosystem and protect Campaigners and Beneficiaries, refunds will not be issued in the following circumstances:

  • Change of mind or donor’s remorse after making a donation.
  • Dissatisfaction with how the Campaigner utilizes the raised funds.
  • The Campaign not reaching its fundraising target amount.
  • Delays in fund utilization or treatment/project commencement by the Campaigner.
  • Disputes between Donors and Campaigners regarding fund usage.
  • The Beneficiary’s medical condition worsening, not improving, or the Beneficiary’s demise.
  • Dissatisfaction with Campaign updates or lack thereof.
  • Funds already withdrawn by the Campaigner and utilized for the stated purpose.

 

Once funds are legally withdrawn by a Campaigner and utilized for the Beneficiary, Chakradhari Foundation cannot reverse, recover, or redistribute those funds.

4. Refund Request Process

To request a refund (where applicable under this Policy), the Donor must follow the steps below:

Step 1: Submit Request

Send an email to foundationchakradhari@gmail.com or call +91-9899144438 with the following details:

  • Full name of the Donor (as per the payment method used)
  • Registered email address and phone number
  • Transaction ID / Payment reference number
  • Campaign name and Campaign URL
  • Date and amount of the donation
  • Detailed reason for the refund request with supporting evidence (if applicable)

Step 2: Verification

Chakradhari Foundation will verify the refund request by cross-checking transaction records with the Payment Gateway, reviewing the Campaign status, and confirming the identity of the requesting Donor. We may request additional documentation during this process.

Step 3: Timeline

Refund requests must be raised within 7 (seven) days of the transaction date. Requests submitted after this window may be rejected at Chakradhari Foundation’s sole discretion.

5. Review & Decision

  • All refund requests are reviewed internally by Chakradhari Foundation’s support and compliance team.
  • Chakradhari Foundation reserves the sole and absolute right to approve or reject any refund request.
  • Decisions are made on a case-by-case basis and are final and binding.
  • We will communicate the decision to the Donor via email within 7 (seven) working days of receiving a complete refund request.
  • Chakradhari Foundation is not obligated to provide detailed justifications beyond what is required by applicable law.

6. Refund Method & Timeline

  • Approved refunds will be processed to the original payment method only. Refunds to a different account are not permitted.
  • Processing time depends on the Payment Gateway, issuing bank, and payment method. Typical timelines range from 7 to 14 working days.
  • Credit card refunds may take up to 2 billing cycles to appear on the Donor’s statement.
  • UPI and net banking refunds are typically faster (5–7 working days).
  • Payment Gateway charges, convenience fees, or transaction fees already deducted may be non-refundable.
  • Chakradhari Foundation shall not be liable for delays caused by Payment Gateways, banks, or other intermediaries.

7. Chargebacks & Payment Disputes

If a Donor initiates a chargeback directly with their bank or card issuer without first contacting Chakradhari Foundation:

  • The transaction and associated Campaign funds may be temporarily frozen pending investigation.
  • Chakradhari Foundation may request additional information from the Donor and/or the Campaigner.
  • Accounts involved in repeated or frivolous chargebacks may be suspended or permanently terminated.
  • Chakradhari Foundation reserves the right to contest chargebacks it believes are unjustified.

 

We strongly encourage Donors to contact us directly before initiating a chargeback, as direct resolution is typically faster and more effective.

8. Refunds for Campaign Surplus

If a Campaign raises more funds than required (e.g., treatment cost is lower than anticipated, or the Beneficiary no longer requires funds), Chakradhari Foundation may, at its discretion:

  • Request the Campaigner to return surplus funds to the Platform.
  • Redirect surplus funds to other similar Campaigns or deserving Beneficiaries.
  • Initiate proportional refunds to Donors, subject to technical feasibility.

9. Governing Law

This Refunds Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

10. Policy Updates

Chakradhari Foundation may update this Refunds Policy from time to time to reflect legal, operational, or regulatory changes. Updates will be posted on the Platform with a revised effective date. Continued use of the Platform after changes constitutes acceptance of the updated Policy.
