These Terms and Conditions (“Terms”) govern your access to and use of the website and mobile applications (collectively, the “Platform”) operated by Chakradhari Foundation, a registered charitable trust (PAN: AADTC2098R, established 09.09.2022) having its office at Laxmi Nagar, New Delhi, India (“Chakradhari”, “we”, “us”, “our”). By accessing, browsing, or using the Platform in any manner, you agree to be bound by these Terms, our Privacy Policy, Refunds Policy, Cancellation Policy, and all other policies published on the Platform (collectively, the “Agreement”).

 

Chakradhari Foundation operates as a technology-enabled crowdfunding platform that enables individuals, groups, NGOs, and other entities to raise funds for charitable, medical, social, and personal causes. The Platform is designed to help the poor, needy, underprivileged, and persons suffering from life-threatening diseases and medical emergencies.

1. Definitions

In these Terms, unless the context otherwise requires:

  • “Campaign” / “Fundraiser”: means a fundraising page created on the Platform by a Campaigner to solicit donations for a specific cause, purpose, or beneficiary.
  • “Campaigner”: means any individual, group, NGO, hospital, trust, or entity that creates a Campaign on the Platform to raise funds.
  • “Donor” / “Contributor”: means any person who makes a monetary contribution to a Campaign through the Platform.
  • “Beneficiary”: means the individual or entity intended to receive the benefit of the funds raised through a Campaign.
  • “User” / “You” / “Your”: means any person who accesses, browses, or uses the Platform in any capacity, including Campaigners, Donors, and visitors.
  • “Platform”: means the Chakradhari Foundation website, mobile applications, and all related services, tools, and features.
  • “Funds”: means the monetary contributions collected through the Platform for a Campaign.
  • “Payment Gateway”: means the third-party payment processing service(s) integrated with the Platform for processing transactions.
  • “Content”: means all text, images, videos, documents, medical records, and any other material uploaded or submitted to the Platform.

2. Nature of Platform & Services

2.1 Platform as Intermediary

Chakradhari Foundation operates as a technology intermediary platform that connects Campaigners seeking to raise funds with Donors willing to contribute. We facilitate the collection and transfer of donations. We are not a party to any transaction between Campaigners and Donors, nor do we guarantee the outcome, authenticity, or success of any Campaign.

2.2 Not a Financial Institution

Chakradhari Foundation is not a bank, financial institution, payment system operator, or a Non-Banking Financial Company (NBFC). We do not provide financial, investment, or advisory services. The Platform merely facilitates the transfer of voluntarily contributed funds from Donors to Campaigners.

2.3 No Guarantee on Fund Utilization

While we make reasonable efforts to verify Campaigns and Campaigner credentials, we do not guarantee, warrant, or take responsibility for how Campaigners utilize the funds raised. Donors acknowledge and accept that the ultimate use of donated funds is the responsibility of the Campaigner.

2.4 Focus Areas

The Platform primarily supports Campaigns related to:

  • Medical emergencies and treatment of life-threatening diseases
  • Support for the poor, underprivileged, and economically weaker sections of society
  • Education and skill development for the needy
  • Disaster relief and rehabilitation
  • Social welfare, community development, and charitable causes
  • Any other cause approved by Chakradhari Foundation at its sole discretion

3. Eligibility

  • You must be at least 18 years of age and legally competent to enter into binding contracts under Indian law.
  • Minors (below 18 years) may use the Platform only under the supervision and consent of a parent or legal guardian, who shall be responsible for all activities conducted under the minor’s account.
  • By registering or using the Platform, you represent and warrant that the information provided is true, accurate, complete, and current.
  • Organizations must be duly registered under applicable Indian law and provide valid registration documents when requested.
  • Chakradhari Foundation reserves the right to refuse access or terminate accounts that fail to meet eligibility requirements.

4. Account Registration & Security

To access certain features of the Platform, you must create an account by providing your name, email address, phone number, and other required information. You agree to:

  • Provide accurate, truthful, and complete information during registration and keep it updated at all times.
  • Maintain the confidentiality of your account credentials (username, password, OTP) and not share them with any third party.
  • Be solely responsible for all activities that occur under your account.
  • Notify Chakradhari Foundation immediately at foundationchakradhari@gmail.com if you become aware of any unauthorized use of your account or any other breach of security.

 

Chakradhari Foundation may suspend, disable, or terminate your account at any time without prior notice if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if required by law or regulatory authorities.

5. Campaign Creation & Campaigner Responsibilities

5.1 Creating a Campaign

Campaigners may create fundraisers by providing complete and accurate details including the purpose of the fundraiser, target amount, beneficiary details, supporting documents (medical reports, prescriptions, hospital bills, identity proofs, etc.), and any other information as may be required by Chakradhari Foundation.

5.2 Campaigner Representations and Warranties

By creating a Campaign, the Campaigner represents and warrants that:

  • All information, documents, images, and descriptions provided are truthful, accurate, and not misleading.
  • The Campaign is for a lawful purpose and does not violate any applicable law, regulation, or the rights of any third party.
  • The Campaigner has the legal authority and consent of the Beneficiary (or their legal guardian) to create and manage the Campaign.
  • The funds raised will be utilized solely for the stated purpose of the Campaign.
  • The Campaigner will provide updates on fund utilization and the Beneficiary’s condition as reasonably requested by the Platform or Donors.

5.3 Verification & KYC

Campaigners are required to complete identity verification and Know Your Customer (KYC) procedures, including submission of government-issued photo ID (Aadhaar, PAN, Passport, Voter ID), bank account details, and any additional documentation before withdrawing funds. Chakradhari Foundation reserves the right to request further documentation at any time and to withhold fund disbursement until satisfactory verification is completed.

5.4 Medical Fundraisers — Special Requirements

For Campaigns related to medical treatment or life-threatening diseases:

  • Valid medical reports, diagnosis certificates, hospital bills, and doctor’s prescriptions must be submitted.
  • Hospital or treating doctor’s contact details may be verified independently by Chakradhari Foundation.
  • Funds may be disbursed directly to the hospital, medical institution, or treatment provider at Chakradhari Foundation’s discretion to ensure proper utilization.
  • Campaigners must promptly inform the Platform if the Beneficiary’s medical condition changes, treatment is completed, or funds are no longer required.

5.5 Campaign Monitoring and Removal

Chakradhari Foundation reserves the right to review, modify, suspend, or remove any Campaign at any time, without prior notice, if:

  • The Campaign contains false, misleading, or incomplete information.
  • The Campaign violates these Terms, applicable law, or Platform policies.
  • Fraud, misrepresentation, or misuse of funds is suspected.
  • Required documents or verification are not provided within the stipulated time.
  • The Campaign receives complaints from Donors or third parties.
  • The Campaign is deemed inappropriate, offensive, or harmful to the Platform’s reputation.

6. Donations — Terms for Donors

6.1 Voluntary Contributions

All donations made through the Platform are voluntary. By donating, you acknowledge that you have reviewed the Campaign details and are making an informed and voluntary decision to contribute. Donations are not payments for goods or services.

6.2 Non-Refundable Nature

Donations are generally non-refundable once successfully processed. Donors should review Campaign details carefully before contributing. For exceptional circumstances, please refer to our Refunds Policy.

6.3 No Guarantee of Campaign Success

Chakradhari Foundation does not guarantee that any Campaign will reach its fundraising goal. Donors acknowledge that the Platform has no obligation to refund donations if a Campaign does not meet its target amount.

6.4 Donor Acknowledgment

By making a donation, the Donor acknowledges and agrees that:

  • The donation is a voluntary contribution and not an investment, loan, or purchase.
  • Chakradhari Foundation acts solely as an intermediary and is not responsible for how the Campaigner utilizes the funds.
  • The Donor has independently evaluated the Campaign and has not relied solely on the Platform’s verification.
  • Any tax benefits or deductions claimed on donations are the Donor’s own responsibility, and the Donor should consult their tax advisor.

7. Fees, Payment Processing & Taxes

7.1 Platform Fee

Chakradhari Foundation currently does not charge any platform fee. Creating accounts, starting campaigns, and managing fundraisers is free. We do not take any percentage from the funds raised. Our goal is to ensure the maximum amount reaches the intended Beneficiary. However, Chakradhari Foundation reserves the right to introduce or modify fees in the future, with prior notice published on the Platform.

7.2 Payment Gateway Charges

All transactions are processed through IndusInd Bank’s IndusCollect service (powered by Razorpay Software Pvt Ltd) and/or other third-party Payment Gateways as applicable. Payment processing charges, as imposed by banks or payment service providers, may apply. These charges vary by payment method (UPI, credit card, debit card, net banking, wallets, etc.) and are clearly displayed during the checkout process. Chakradhari Foundation does not control, retain, or profit from these charges.

7.3 Taxes

Donations may be subject to applicable taxes under prevailing Indian law. Chakradhari Foundation does not provide tax advice. If the Foundation holds registration under Section 80G of the Income Tax Act, 1961, applicable tax exemption certificates shall be issued as per law. Donors are advised to consult their own tax advisors regarding the tax implications of their donations.

7.4 GST

Goods and Services Tax (GST) may apply on certain platform service charges, if any, as per the applicable GST laws. Any such taxes will be separately indicated during the transaction process.

8. Fund Withdrawal & Utilization

  • Campaigners may request withdrawal of raised funds after completing KYC verification and meeting Platform criteria.
  • Chakradhari Foundation may disburse funds in instalments, directly to hospitals/service providers, or in full to the Campaigner’s verified bank account, at its discretion.
  • Withdrawals may be subject to holds for chargebacks, pending verifications, or suspected fraud.
  • Misuse of funds is strictly prohibited. Campaigners found to have misused funds may face account suspension, legal action, and reporting to law enforcement authorities.
  • If the Beneficiary no longer requires the funds (e.g., treatment completed, recovery, or demise), the Campaigner must inform Chakradhari Foundation. Surplus funds may be redirected to other deserving Campaigns or returned to Donors, at the Foundation’s discretion.

9. Prohibited Conduct & Campaigns

Users shall not use the Platform to:

  • Create fraudulent, misleading, or fictitious Campaigns.
  • Raise funds for illegal activities, terrorism, money laundering, or any activity that violates Indian law.
  • Solicit funds for campaigns promoting hatred, violence, discrimination, or communal disharmony on the basis of religion, caste, gender, race, or ethnicity.
  • Misrepresent identity, medical condition, beneficiary details, or affiliation with any organization.
  • Upload obscene, defamatory, objectionable, or infringing content.
  • Upload malware, viruses, or code designed to disrupt, damage, or interfere with the Platform.
  • Engage in spamming, phishing, or unsolicited communication through the Platform.
  • Circumvent or attempt to circumvent any security measures, access controls, or usage limits of the Platform.
  • Use the Platform for any commercial purpose not authorized by Chakradhari Foundation.

 

Violation of any of the above may result in immediate removal of content, suspension or termination of accounts, forfeiture of funds, and referral to law enforcement authorities.

10. Content & Intellectual Property

10.1 User Content

By submitting any Content to the Platform (including Campaign descriptions, images, videos, documents, and medical records), you grant Chakradhari Foundation a non-exclusive, royalty-free, worldwide, transferable, and sub-licensable licence to use, reproduce, display, distribute, and modify such Content for the purposes of operating, promoting, and improving the Platform and the Campaigns hosted thereon.

10.2 Platform Content

All content on the Platform that is owned by Chakradhari Foundation — including text, logos, graphics, designs, software, and trademarks — is the intellectual property of Chakradhari Foundation and is protected under applicable Indian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

10.3 Accuracy of Content

Chakradhari Foundation does not independently verify all content submitted by Campaigners. Users access Campaign information at their own risk. We are not liable for the accuracy, completeness, or reliability of user-submitted content.

11. Disclaimers & Limitation of Liability

11.1 Platform Provided “As Is”

The Platform and all services are provided on an “as is” and “as available” basis without any warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

11.2 No Warranty on Campaigns

Chakradhari Foundation does not warrant or guarantee that any Campaign is authentic, that funds will be used as described, or that the Campaign will achieve its stated goal. Donors contribute at their own discretion and risk.

11.3 Limitation of Liability

To the maximum extent permitted by applicable law, Chakradhari Foundation, its trustees, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to: loss of data, loss of revenue, loss of goodwill, personal injury, emotional distress, or damages arising from any Campaign, donation, or interaction with other Users. Our total aggregate liability, if any, shall not exceed the total fees (excluding third-party payment gateway charges) paid by you to Chakradhari Foundation in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Chakradhari Foundation, its trustees, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your breach of these Terms; your use or misuse of the Platform; any Campaign created by you; any Content submitted by you; any violation of applicable law or the rights of any third party; or any dispute between you and another User.

13. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect your personal information. By using the Platform, you consent to the collection and use of your data as described in our Privacy Policy. We are committed to protecting your data in compliance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023, as applicable.

14. Third-Party Services & Links

The Platform may contain links to third-party websites, services, or applications (including payment gateways, verification services, and social media platforms). These are provided for convenience only. Chakradhari Foundation does not endorse, control, or assume any responsibility for the content, privacy policies, or practices of any third-party service. Your interactions with third-party services are governed by their respective terms and policies.

15. Communications

By registering on the Platform, you consent to receive communications from Chakradhari Foundation via email, SMS, phone calls, push notifications, and WhatsApp, including but not limited to: transaction confirmations, campaign updates, account notifications, promotional communications, and important notices. You may opt out of promotional communications by using the unsubscribe option, but transactional and security-related communications cannot be opted out of.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

17. Dispute Resolution

In the event of any dispute arising out of these Terms or the use of the Platform, the parties shall first attempt to resolve the dispute amicably through good-faith negotiation. If the dispute is not resolved within 30 (thirty) days of the first written notice, either party may refer the dispute to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be New Delhi, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

18. Force Majeure

Chakradhari Foundation shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil commotion, government actions, strikes, power failure, internet outages, server failures, or failure of third-party payment processors.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

20. Waiver

No failure or delay by Chakradhari Foundation in exercising any right or remedy under these Terms shall constitute a waiver thereof, nor shall any single or partial exercise of any right preclude any further exercise of that right or any other right.

21. Entire Agreement

These Terms, together with the Privacy Policy, Refunds Policy, Cancellation Policy, Shipping & Delivery Policy, Product Pricing Policy, and any other policies published on the Platform, constitute the entire agreement between you and Chakradhari Foundation and supersede all prior agreements, representations, and understandings.

22. Amendments

Chakradhari Foundation reserves the right to update, modify, or amend these Terms at any time. Updated Terms will be posted on the Platform with a revised effective date. Your continued use of the Platform after such changes constitutes your acceptance of the amended Terms. We encourage you to review these Terms periodically.
